Terms of Service

These terms govern your use of https://coldrescue.ca and your request for service from Cold Rescue Inc. (“Cold Rescue”, “we”, “us”). By using this website or requesting dispatch, you agree to these terms.

Requesting Service

A submission through this website or a phone call to our dispatch line is a request for service, not a confirmed booking. Dispatch will confirm ETA, trailer availability, and scope with you directly before a technician or trailer is deployed. Estimated response times are targets, not guarantees, and can be affected by weather, traffic, and current call volume.

Pricing & Payment

Service pricing depends on equipment, scope of repair, trailer duration, and location, and is confirmed with you before or at the time of dispatch unless otherwise agreed in writing. Payment terms will be communicated by your dispatcher or provided on your invoice.

Warranty

Repairs performed by our licensed mechanics are covered by a parts and labor warranty as described at the time of service. This warranty does not cover pre-existing equipment faults unrelated to the repair performed, damage from misuse, or failures caused by components outside the scope of the original repair.

Mobile Cold Storage & Bailee Coverage

While your goods are in our custody in a mobile reefer trailer, they are covered under our bailee's customer goods insurance, subject to the policy's terms and limits. You remain responsible for accurately describing the goods and any special handling requirements to dispatch.

Limitation of Liability

To the extent permitted by law, Cold Rescue is not liable for indirect, incidental, or consequential damages arising from a service call, including business interruption beyond the direct scope of the repair and storage service provided. Nothing in these terms limits liability that cannot be limited under applicable Ontario or Canadian law.

Website Use

You agree not to misuse this website, including attempting to interfere with its operation, scrape it in violation of our robots.txt directives, or submit false or malicious information through our forms.

Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
